Plant Care: Watering Reminder

These Terms of Use (“Terms”) govern your use of the mobile application Plant Care: Watering Reminder (the “App”), provided by MobArts Ltd (“MobArts”, “we”, “us”, or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. License

MobArts grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, in accordance with these Terms and the Apple Media Services Terms and Conditions, including the Apple Standard End User License Agreement (EULA), which applies to the App in addition to these Terms.

2. Acceptable Use

You agree not to:

• copy, modify, distribute, sell, or lease any part of the App;
• reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent permitted by applicable law;
• use the App for any unlawful purpose or in any way that could damage, disable, or impair the App.

3. Subscriptions and Purchases

The App offers an optional premium tier (“Pro”) that unlocks additional features. Pro is available as:

• an auto-renewable subscription (monthly or yearly), and
• a one-time lifetime purchase.

The following applies to auto-renewable subscriptions:

• Payment is charged to your Apple ID account at confirmation of purchase.
• The subscription automatically renews unless it is cancelled at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
• You can manage or cancel your subscription, and turn off auto-renewal, in your device’s App Store account settings after purchase.
• If a free trial is offered, any unused portion of the free trial is forfeited when you purchase a subscription.

Prices are shown in the App and may vary by region. All purchases are processed by Apple; MobArts does not receive or store your payment details. Refunds, where applicable, are handled by Apple in accordance with its policies.

4. Disclaimer

The App is a tool that helps you organize and receive reminders for plant-care activities. Reminders are scheduled locally on your device and depend on system notification permissions and device availability. MobArts does not guarantee that notifications will always be delivered on time, and is not responsible for the health or survival of your plants. You remain solely responsible for the care of your plants.

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose and non-infringement.

5. Limitation of Liability

To the maximum extent permitted by law, MobArts shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App.

6. Changes to These Terms

We may update these Terms from time to time. Changes become effective when the updated version is posted at this address. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

7. Governing Law

These Terms are governed by the laws of the Republic of Bulgaria, without regard to conflict-of-law principles. Any disputes shall be subject to the jurisdiction of the competent courts of Bulgaria.
